In part because the criminal jurisdiction provides far more rights to individuals than the "civil" jurisdiction of immigration. 8th amendment simply doesnt apply to immigrants because of the 1892 scotus ruling: Fong Yue Ting vs United States. It basically said that because immigration is not "punishment" then cruel and unusual practices can take place.
