Designating transgender people as a category of terrorists is unconstitutional and would have severe, far-reaching consequences, but it cannot be done under existing law. Current federal law provides no mechanism for designating a domestic group or an entire ideology as a terrorist organization. Any attempt to do so would face significant legal hurdles, including violating First Amendment rights.
