A good day for 1A. The Court granted our Motion to Dismiss in Larry Klayman v. @wonkette and Rebecca Schoenkopf, saying, “Defendant’s statements do not present an actionable basis for claims of defamation because they are protected statements of pure opinion or rhetorical hyperbole.”

While it allows Klayman a chance to amend, it also found he was a “public figure” and thus subject to actual malice standard. This makes these weaponized attacks legally frivolous. The judge even noted, “Finally, it cannot be seriously disputed that Plaintiff played a central role in these controversies.”

We will seek fees/costs and fight any attempt at appeal. “Defendants’ insinuation that sexual harassment is a “favorite hobby” of Plaintiff, or that he sued all members of a race and subpoenaed a former president’s genitals, are obvious exaggerations intended for comedic effect.” Rock on, Wonkette and Rebecca.
