Below are several paragraphs from the AP story on the case. Bolded portions are my emphasis of the article.

But it cannot be treated worse than its peer wire service either.” In other words, sometimes AP will be in the pool, and sometimes not.

Additionally, the article states, "The judge said that his decision does not prohibit a government official from choosing which outlets to give interviews to, or choosing which journalists’ questions they choose to answer at a news conference."
