6. I think it would at least be a good legal argument in federal court.

The National Guard is supposed to be subject to the Governor of the state. If the Governor is already using the Guard, then it would be harder for Trump to over ride that and try to federalize them.

The judge in CA just ruled that Trump violated the law in what he did there, of course that will be appealed again.
