Are Trump & Hegseth Using Soldiers' Social Media Posts As Pretext To Punish 1st Amendment Speech? - Glenn Kirschner
In part 2 of a 3-part series involving my interview with law professor, military law expert, and retired Army JAG officer Dan Maurer, we discuss the issue of how First Amendment Free Speech rights apply to members of the United States military.
In the aftermath of the murder of Charlie Kirk, military leadership has been scrutinizing the social media posts of military member to see what they are saying about the Kirk killing. Recent reporting reveals that several military members have been punished as a result of what the military claims are improper posts/statements.
However, some of the reporting raises the issue of whether the Trump administration is using Kirk-related speech to identify and punish military members who say things that displease Trump or Pete Hegseth but that are protected by the First Amendment. - Glenn Kirschner - 09/21/2025.
