Lawsuit filed to challenge charter schools in West Virginia unless county voters are given chance to approve each school


CHARLESTON, W.Va. (WV News) — Two parents, who are also school teachers, have filed suit in Kanawha County Circuit Court to stop the state's efforts to implement a charter school system.

The lawsuit alleges that the law passed by the Legislature and signed into law by Gov. Jim Justice violates the state's constitution.

The law allows the appointed Professional Charter School Board to approve charter schools, violating part of the constitution that the teachers say requires voter approval.

The constitution says “no independent free school district or organization shall hereafter be created, except with the consent of the school district or districts out of which the same is to be created, expressed by a majority of the voters voting on the question," the lawsuit reads.
