Bill to protect medical marijuana users from prosecution moves to House

BATON ROUGE — The House Judiciary Committee Monday favorably moved a bill to the full House that would exempt patients, pharmacists and lab personnel involved with the state-sponsored medical marijuana program from arrest and prosecution.

Under the existing Uniform Controlled Dangerous Substances Law, legally sanctioned medical marijuana users, producers and dispensers are protected from prosecution but not arrest. Senate Bill 35 by Sen. Yvonne Colomb, D-Baton Rouge, remedies that.

Colomb’s legislation does not prevent the arrest or prosecution of any person who uses or distributes medical marijuana outside the scope of the state-sponsored program.
