Legal filing withdrawn amid Fort Myers Beach recall election controversy

This comes after Lee County Supervisor of Elections Tommy Doyle announced candidate qualifying dates for the Town of Fort Myers Beach special recall election, even though councilmembers voted to refrain from establishing qualifying dates one day prior.

"Our Town attorney, Nancy Stuparich, made it clear that the council was not mandated to set qualifying dates for the recall election," Councilwoman Karen Woodson said in a statement. "Relying on this professional opinion, I acted within my legal rights and responsibilities

On Friday, an attorney filed an emergency motion on behalf of Former Mayor Ray Murphy and former Councilman Bill Veach accusing Councilmembers John King and Karen Woodson of violating Florida law.

"This whole recall is based on false accusations and deceit, lying to their petitioners who signed the recall ballot about the real reason they moved in this direction, the vote on Seagate," Councilwoman Woodson said in a statement. "The suggestion that I violated Florida law is totally incorrect."
