Expedited rulemaking. Federal agencies are usually required to publish a proposed rule in the Federal Register and solicit public comments before finalizing regulations. However, there are exceptions to expedite rulemaking in certain circumstances, such as for an emergency or other “good cause.” Although agencies often request public comments on rules they’ve expedited, they do not always respond to these comments.

I'm sure they'll argue it's for emergency or other "good cause" but I'm not sure that holds up in court.

I understand what you're saying and why, and I agree. But who thinks it would make a difference to the trump administration? They are totally lawless, even to the constitution and our rights. Why would breaking this rule be any different to them? And who's going to make them do otherwise? The Judicial branch may gig them, but it's the executive branch that's tasked with carrying out the laws. If the executive branch won't do it, who will make them and how? We've already proven you can't touch a president (or even anyone who's gotten close to the Oval Office), even if he's a thief, a liar, a con artist, and a rapist, as well as an insurrectionist.
