Trump administration moves forward with push to fire Fed governor Lisa Cook

The Trump administration on Sunday renewed its request to a federal appeals court to fire Lisa Cook, a Federal Reserve governor who has faced political scrutiny in recent weeks.

The move comes ahead of the independent central bank’s vote on interest rates this week. President Donald Trump has repeatedly called for the Fed to slash interest rates while publicly targeting Fed chair Jerome Powell. The Trump administration filed its request to the US Court of Appeals for the District of Columbia ahead of Sunday’s 3 p.m. ET deadline.

The Trump administration called Cook’s claims to stay on the board “meritless,” adding that concerns over whether Cook misrepresented her finances pose concerns as to “whether Cook can be trusted to act with forthrightness, care, and disinterest in managing the U.S. money supply.”

Lowell & Associates, which is representing Cook, did not respond to CNN’s request for comment

Judge Cobb found that there was no cause to fire Lisa Cook. trump is appealing to the DC Circuit which has set a very short time frame for briefing.

I was pleased to see that this filing contained a footnote on the recently disclosed facts that showed that Lisa Cook did NOT commit mortgage fraud

The article in the OP did not have a link to the trump DOJ filing. I am looking forward to reading this filing to see if trump objects to Abbie Lowell filing the article on the fact that Lisa Cook did not commit mortgage fraud

I was amused to see that this brief did not discuss the use of the material showing that Lisa Cook did not violate the law. This filing ignores that material and is arguing that trump's decision is not reviewable by the courts.

When one party uses material that is not in the record below normally the other side will object. Here the DOJ did not object and is hoping that the DC Court of Appeals will ignore the fact that Lisa Cook did not violate the law. Here is the footnote that the DOJ is ignoring

The White House’s claim against Cook is rooted in the idea that she committed mortgage fraud, and now there’s fresh evidence to suggest she did not.

There’s no shortage of problems with this, but an especially important one emerged late last week. NBC News reported:

Federal Reserve governor Lisa Cook declared in financial forms that her Atlanta property would be used as a ‘vacation home’ and not her primary residence, according to documents obtained by NBC News that appear to undercut the Trump administration’s allegations of mortgage fraud.


.......So, the administration is giving up? Of course not. The New York Times reported:

The Trump administration sought to convince a federal court on Sunday that President Trump possesses vast powers and ‘discretion’ to fire federal officials, as it raced to block Lisa Cook, a governor on the Federal Reserve, from participating in this week’s meeting of the central bank.


A federal district court ruled last week that Cook can only be legally ousted for cause, and the White House has failed to meet that threshold. The administration’s lawyers have appealed that ruling, insisting that Trump’s power is “unreviewable.”

The case is now pending at the U.S. Court of Appeals for the D.C. Circuit, though time is of the essence. The Times’ report added, “The Trump administration has asked the appellate panel to stay that order and rule by the end of Monday, ahead of the Fed’s two-day meeting, which begins on Tuesday.”

Again, no one is even bothering with the pretense that the administration is scrambling to oust Cook because of a desperate need for swift justice related to the mortgage bureaucracy. Rather, the White House sees an opponent that it’s eager to remove from the board. Watch this space.

Amid the controversy, the personal finances of other government officials and their families have also come into question by rival politicians, the media and others.
Last week, Reuters reported that Pulte’s own father and stepmother had declared two homes in two different states as their primary residence, prompting a town in Michigan to remove a tax exemption for their home there and charge the couple for back taxes. Pulte and his parents didn’t respond to requests for comment about the matter.

BREAKING: On a 2-1 vote, the D.C. Circuit rejects the Trump administration's request to allow Trump's purported firing of Fed Board Governor Lisa Cook to take effect during litigation.

She will remain on the board for now, absent a further court order to the contrary.
