Trump admin immediately violates judge's orders in high-profile case: court filing

The Trump administration has been persistent in its efforts to deport Kilmer Abrego Garcia, a migrant previously deported to El Salvador without charge due to an administrative error, and on Monday, defiantly violated a federal judges order as it pertains to the case, according to new court documents.
Now facing charges of human trafficking, Garcia was released from a Tennessee prison on Friday, only to surrender himself to an Immigrations and Customs Enforcement facility on Monday. Yet, despite an order from U.S. Magistrate Judge Barbara Holmes that Garcia be granted access to his legal counsel, ICE officials have ignored such requests, according to new filings from his legal team.
Defense counsel called (an ICE) phone number to request a legal call, and the operator was unable to schedule a call, directing counsel to send an email, reads the legal filing, submitted on Monday.
Counsel then emailed the ICE email address and requested a legal call; we have yet to receive any response. This process does not comply with Magistrate Judge Holmess release order, which required the government to facilitate access to Mr. Abrego if he were taken into ICE custody.

(27,907 posts)Also the various Bar Associations where they are licensed should be suspending or stripping their licenses to practice law.

(2,552 posts)and they are proven in non compliance, Lock them up on the spot for contempt. Judges do that all the time with defendants, so do the same for lawyers who are sandbagging the court. And don't let them out until they obey the court's ruling..
That is the problem - judges let lawyers play games with the courts, and refuse to come down on them..

(13,070 posts)I'm so tired of there being a different set of rules for the wealthy, especially TSF. Put everyone of those attorneys into prison until they follow all the judges instructions to the letter for at least 6 months.

(12,751 posts)It's easier to identify a person who has done something than it is to identify someone who has failed to do something. In this case, for example, how do you find the person who did NOT respond to the email? Though if you did, you'd probably still have to determine who it was who instructed the person not to respond.
I assume the person at the DOJ who was ultimately responsible for assuring that access to Mr. Abrego was Pam Bondi. But it might be hard to jail her without proving that she was the reason those attempts to contact him failed.
I guess the point is, when it comes to "the department" failing to follow an order, there's enough potential denial and finger-pointing that it may be difficult to identify one ore more individuals to specifically jail for contempt.
And then to your specific point, I don't think DOJ's failure to do what was asked (provide that access to Mr. Abrego) can necessarily be pinned on the particular lawyers who argued the case and received the directive.

(12,751 posts)I would have though s/he could avoid the contempt charge by saying they had informed higher-ups (e.g. Bondi or whoever) that access to Garcia via ICE must be provided, but that they had no personal ability to provide that access, so should not be jailed for not implementing something that was beyond their ability to personally implement. So being that lawyer makes them personally legally responsible for providing that access? Tough gig!
