Judge says law allowing undocumented students to pay in-state tuition is unconstitutional

A federal judge in Muskogee has declared unconstitutional an Oklahoma law that allows undocumented students to pay in-state tuition at Oklahoma colleges and universities.

U.S. District Judge Ronald White issued his one-page order on Friday, Aug. 30, saying the law as applied to people who are not "lawfully present in the United States violates the Supremacy Clause."

In issuing the order, White granted a request filed on Aug. 5 by Oklahoma Attorney General Gentner Drummond and the U.S. Department of Justice, who jointly asked the judge to deem the state law invalid.

Rep. Arturo Alonso-Sandoval, D-Oklahoma City, said the ruling — and the fact that Drummond supported it — will only serve to hinder the state's efforts to build its workforce in critical areas.
