Group of 138 retired judges urges federal court to drop charges against Hannah Dugan
A bipartisan group of more than 130 former state and federal judges filed a brief on May 30 supporting a motion to dismiss the criminal charges against Milwaukee County Judge Hannah Dugan, saying the case could have a "chilling effect" on judges around the nation.
The 21-page amicus brief argues that the two federal charges against Dugan represent "an extraordinary and direct assault on the independence of the entire judicial system." Dugan was indicted last month on charges she helped an undocumented immigrant evade federal officers after he appeared in her courtroom.
"Permitting the prosecution of a state circuit court judge for conduct falling squarely within her rightful exerciseof judicial discretion establishes a dangerous precedent that will chill judicial decision-making at every level," said the brief by the 138 retired judges. "This case directly threatens the ability of all judges to do their jobs without fear of retaliatory prosecution."
