But the fight over whether Congress' decision to do so or President Donald Trump's efforts to stop California in its effort to block the sale of vehicles with internal combustion engines as a means of reducing greenhouse gases is legal, is just beginning.
"We intend to sue the Trump administration," California Attorney General Rob Bonta said at a news conference on May 22. "This is unprecedented."
Earlier in the day, the U.S. Senate voted 51-44 in favor of a resolution already passed in the House to turn back the Biden administration waiver granted to California by the Environmental Protection Agency (EPA) about a month before Biden left office this January. That waiver allows the state to move ahead with a program requiring an increasing share of new cars, trucks and SUVs sold to be zero emission or otherwise penalize automakers.
Both congressional chambers passed the resolution after Trump's new EPA head, Lee Zeldin, asked for a legislative review under a law the Congressional Review Act, or CRA that allows the House and Senate to reject some agency-finalized rules within 60 business days of their being notified.

(15,164 posts)A substantial number are employed in the auto industry (many unionized) which is a significant part of Michigan's economy. Consumers aren't ready to buy EV in the numbers required to meet the mandates. If they don't, the manufacturers are the ones that get penalized.
The most effective incentive to get people to replace their ICE powered vehicles with EV is make operating them much more expensive with higher gasoline prices. I know people don't like that, but to expect people to dump ICE vehicles when gas is relatively cheap isn't rational.
States that want to still encourage a transition to EV, could, on their own, increase their gas taxes by a couple dollars a gallon or more over time and still move towards meeting their EV goals.

I continue to believe we should be incentivizing Vermonters to transition to cleaner energy options like electric vehicles. However, we have to be realistic about a pace thats achievable. Its clear we dont have anywhere near enough charging infrastructure and insufficient technological advances in heavy-duty vehicles to meet current goals, said Governor Scott. We have much more work to do, in order make it more convenient, faster, and more affordable to buy, maintain and charge EVs. When we do, its more likely everyday Vermonters will make the switch.
Governor Scott remains committed to addressing climate change, including advocating for more charging infrastructure, which is key to supporting Vermonters in making EVs viable and reducing transportation emissions. When it comes to transitioning to a low-carbon future, mandates are not going to be the total answer. Using common sense and incentivizing technological advancements is necessary to overall success and this compliance flexibility is intended to reflect this reality.
