Emil Bove III has emerged as a top contender to fill a vacancy on the appeals court covering Pennsylvania, New Jersey and Delaware, people familiar with the matter said.

President Trump is considering nominating Emil Bove III, a top Justice Department official responsible for enacting his immigration agenda and ordering the purge of career prosecutors, to be a federal appeals judge, according to people familiar with the matter.
Mr. Bove, 44, is a former criminal defense lawyer for Mr. Trump and a longtime federal prosecutor in New York. He was the Justice Department official at the center of the Trump administrations request earlier this year to dismiss a corruption case against the mayor of New York, Eric Adams.
One of the departments most formidable and feared political appointees in the second Trump administration, he has emerged as a top contender to fill a vacancy on the U.S. Court of Appeals for the Third Circuit, which covers Pennsylvania, New Jersey and Delaware, those people said.
There are two vacancies on the court one based in New Jersey and one in Delaware. It is not clear which seat Mr. Bove is under consideration for. He has a property in Pennsylvania, and some conservatives have called for moving the Delaware-based seat to Pennsylvania.
If Mr. Bove is nominated for the post, Democrats are all but certain to use his Senate confirmation process to scrutinize his role in some of the Justice Departments most contentious actions since Mr. Trump took office.

Hours after Trump took office in January, Bove was tapped to assume one of the most powerful positions at the Justice Department its No. 2 spot, the interim deputy attorney general. He stayed in the job for weeks before the permanent nominee, Blanche, who worked with Bove to defend Trump in his criminal cases, was confirmed by the Senate.
In that short time, Bove quickly earned a reputation as Trumps hatchet man. His aggressive campaign began with immigration he issued a memo just two days after Trumps inauguration that threatened to prosecute state and local officials who resist the administrations federal immigration crackdown.
Bove then turned his attention to the FBI, ordering the firing of eight senior officials and demanding details on thousands of employees who worked on investigations related to the US Capitol riot on January 6, 2021.
But his most controversial move was when he and others submitted a filing to dismiss the corruption charges against New York City Mayor Eric Adams, sparking a wave of resignations from career prosecutors in the Southern District of New York and the Justice Departments Public Integrity Section who said it amounted to a quid pro quo.
Bove eventually had to appear in court by himself to argue for the dismissal, which a judge granted.
